本利用規約（以下「本規約」）は、BeliveApp Tech（以下「当社」）が提供するiOS用アプリケーション「無音カメラ」（Silent Camera）（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロード、インストール、またはご利用いただくことにより、お客様は本規約のすべての条項に同意したものとみなされます。

1. 本サービスの提供およびライセンス

当社はお客様に対し、本規約およびAppleのメディアサービス利用規約に従い、お客様が保有する互換性のあるiOSデバイス上での個人的・非営利的な目的に限り、本アプリを使用するための非独占的、譲渡不能、再許諾不可の限定的ライセンスを付与します。

2. 禁止事項

お客様は、本アプリの利用にあたり、以下の行為を行ってはならないものとします：

• 他人のプライバシーや肖像権、著作権、名誉を侵害する態様での無断撮影。
• 公共の場所またはプライベートな空間において、周囲に不安や迷惑を与える撮影行為。
• 本アプリのリバースエンジニアリング、逆コンパイル、逆アセンブル、またはソースコードの抽出。
• 本アプリの改変、複製、再頒布、販売、または派生著作物の作成。
• 本アプリに組み込まれたセキュリティ機能や広告表示メカニズムを回避・無効化する試み。
• 法令、公序良俗、または本規約に違反するあらゆる行為。

3. 知的財産権

写真データの権利： お客様が本アプリを通じて撮影したすべての写真および画像データの著作権および所有権は、100%お客様に帰属します。当社が写真データの権利を取得したり、写真を利用することは一切ありません。

アプリの権利： 本アプリ自体のプログラム、アルゴリズム、UIデザイン、グラフィックス、ロゴ、商標に関するすべての権利は、当社または正当な権利者に帰属します。

4. 有料プラン（Pro版）およびサブスクリプション規約

本アプリは無料でも基本機能をご利用いただけますが、追加機能や広告非表示を提供する「無音カメラ Pro」プランを用意しております：

• 決済： サブスクリプションおよび買い切りプラン（Lifetime Access）のお支払いは、お客様のApple IDアカウント（StoreKit）を通じて請求されます。
• 自動更新： サブスクリプションは、現在の請求期間が終了する少なくとも24時間前までに自動更新を無効にしない限り、自動的に同一条件・同一料金で更新されます。
• 解約方法： お客様はいつでもiOSの「設定」アプリ > [お客様のApple ID] > 「サブスクリプション」より、自動更新の停止・解約を行うことができます。
• 返金： Appleの規定に基づき、アプリ内課金の返金手続きはすべてApple Inc.の管理下にあります。返金を希望される場合はAppleサポート（reportaproblem.apple.com）へ直接申請してください。

5. 広告の表示（無料版）

無料版ではGoogle AdMobによる広告（App Open、インタースティシャル等）が表示されます。広告の表示頻度やフォーマットは当社の裁量で調整される場合があります。Pro版をご購入いただいた場合、すべての広告は直ちに非表示となります。

6. 免責事項（保証の否認）

本アプリは「現状有姿」（AS IS）かつ「利用可能な限度」（AS AVAILABLE）で提供されます。当社は、本アプリの完全性、特定目的への適合性、バグの不存在、またはハードウェアやiOSの将来のバージョンとの永続的な互換性について、明示または黙示を問わずいかなる保証もいたしません。

本アプリの使用または使用不能から生じた直接的、間接的、付随的、結果的損害（写真データの消失、端末の不具合、第三者との紛争等を含む）について、当社は法律で認められる最大限の範囲において一切の責任を負いません。

7. 規約の変更

当社は必要に応じて本規約をいつでも変更することができます。変更後の規約は本ウェブサイトに掲載された時点で効力を生じるものとします。変更後も本アプリを継続して使用することにより、改定後の規約に同意したものとみなされます。

8. 準拠法および管轄

本規約の解釈および適用は日本法に準拠するものとし、本規約または本アプリに起因する紛争については、当社所在地を管轄する地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Use ("Terms", "Agreement") constitute a legally binding agreement between you ("User" or "you") and BeliveApp Tech ("Company", "we", "us", or "our") governing your download, installation, and use of the Silent Camera ("無音カメラ") mobile application ("the App"). By installing, accessing, or using the App, you agree to be bound by these Terms.

1. License Grant

Conditioned upon your compliance with these Terms and the Apple Media Services Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and execute the App solely on compatible iOS hardware that you own or control for personal, non-commercial purposes.

2. Prohibited Uses

You agree that you will not:

• Use the App to photograph individuals without their consent in locations where a reasonable expectation of privacy exists.
• Violate any local, national, or international statute, ordinance (including Japanese Nuisance Prevention Regulations), or common law privacy rights.
• Decompile, reverse engineer, disassemble, decrypt, or attempt to derive the source code of the App.
• Copy, modify, adapt, translate, rent, distribute, or create derivative works based on the App.
• Circumvent or tamper with in-app purchase protections, advertisement delivery engines, or security frameworks.

3. Intellectual Property Rights

Your Photographs: You retain 100% full, exclusive ownership and copyright over all photos captured using the App. BeliveApp Tech never claims ownership, licenses, or access to your media files.

Company Ownership: The App codebase, optical rendering pipeline, tactile haptic interfaces, porcelain aesthetic designs, trademarks, and documentation remain the exclusive intellectual property of BeliveApp Tech.

4. In-App Purchases and Subscriptions

Silent Camera provides optional Pro tier upgrades via In-App Purchase:

• Billing: Transactions are billed to your Apple ID account upon purchase confirmation through Apple StoreKit.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours prior to the conclusion of the current billing cycle.
• Cancellations: You may manage or cancel subscriptions at any time via iOS Settings > [Your Apple ID] > Subscriptions.
• Refunds: All payments are handled directly by Apple Inc. Refund requests must be submitted directly to Apple via reportaproblem.apple.com.

5. Advertising in Free Version

The free tier of Silent Camera displays third-party advertisements via Google AdMob to finance operational and engineering costs. Active Pro subscribers receive a completely ad-free experience without promotional interruptions.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, FREEDOM FROM ERRORS, OR UNINTERRUPTED OPERATION.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BELIVEAPP TECH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, DEVICE MALFUNCTION, OR DISPUTES ARISING FROM YOUR PHOTOGRAPHIC ACTIVITIES.

8. Modifications to Terms

We reserve the right to revise or modify these Terms at any time. Any revisions become effective immediately upon publication on our website. Continued use of the App following updates signifies your acceptance of the revised Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles. Any legal action arising from these Terms or the App shall be instituted exclusively in the competent courts of Japan.
