LunaCycle: Terms of Service
Welcome to LunaCycle (the "Service", "App", or "Application"), provided and operated by BeliveApp Tech ("we", "our", or "us"). By downloading, installing, or accessing LunaCycle, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use the Application.
1. Usage License & Intellectual Property
BeliveApp Tech grants you a personal, revocable, non-exclusive, non-transferable, and limited license to download, install, and utilize LunaCycle on Apple iOS devices owned or controlled by you, solely for personal, non-commercial purposes.
All design assets, user interfaces, branding, custom algorithms, illustrations, code, and editorial materials within LunaCycle are the exclusive intellectual property of BeliveApp Tech and are protected by applicable trademark, copyright, and international intellectual property laws. You agree not to:
- Copy, modify, reverse engineer, decompile, or disassemble any part of the App.
- Distribute, lease, rent, sublicense, or commercially exploit any functionality of LunaCycle.
- Circumvent or tamper with in-app purchase validation, security features, or gating mechanisms.
2. Medical & Health Disclaimer (Important Notice)

2.1 NOT MEDICAL ADVICE OR HEALTHCARE SERVICES:
BELIVEAPP TECH IS NOT A LICENSED HEALTHCARE PROVIDER, HOSPITAL, CLINIC, OR EMERGENCY SERVICE. LUNACYCLE AND ITS CONTENTS, ALGORITHMS, PREDICTIVE MODELS, SYMPTOM CHARTS, AND WELLNESS GUIDES ARE PROVIDED EXCLUSIVELY FOR INFORMATIONAL, EDUCATIONAL, AND PERSONAL SELF-AWARENESS PURPOSES.
THE APP IS NOT DESIGNED, INTENDED, OR AUTHORIZED TO DIAGNOSE, TREAT, CURE, MITIGATE, OR PREVENT ANY DISEASE, GYNECOLOGICAL ILLNESS, HORMONAL DYSFUNCTION, OR PREGNANCY COMPLICATION. NEVER DISREGARD FORMAL MEDICAL ADVICE OR POSTPONE SEEKING PROFESSIONAL CLINICAL CARE BECAUSE OF CALCULATIONS, NOTIFICATIONS, OR INSIGHTS PRESENTED IN LUNACYCLE.
2.2 NOT A FORM OF CONTRACEPTION (NOT BIRTH CONTROL):
LUNACYCLE IS NOT AN FDA-CLEARED, TGA-APPROVED, OR CE-MARKED MEDICAL CONTRACEPTIVE DEVICE. OUR MENSTRUAL CYCLE FORECASTS, OVULATION ESTIMATES, BASAL BODY TEMPERATURE (BBT) LOGS, AND FERTILE WINDOW APPROXIMATIONS ARE MATHEMATICAL PREDICTIONS SUBJECT TO NATURAL BIOLOGICAL VARIABILITY. UNDER NO CIRCUMSTANCES SHOULD LUNACYCLE BE UTILIZED AS A METHOD OF BIRTH CONTROL, CONTRACEPTION, OR FAMILY PLANNING TO AVOID UNINTENDED PREGNANCY.
2.3 MATERNAL SUITE & KICK COUNTER DISCLAIMER:
The pregnancy calendar, weekly gestational milestones, baby fruit size analogies, and fetal kick counter sessions are supportive tracking utilities for expecting mothers. They do not replace regular prenatal appointments, clinical fetal heart rate auscultation, or diagnostic ultrasound examinations. If you notice a sudden decrease, cessation, or abnormal change in fetal movements, contact your obstetrician, midwife, or maternity assessment center immediately.
2.4 CONTRACTION TIMER & 5-1-1 PROTOCOL DISCLAIMER:
The contraction timing tool and associated triage educational indicators (such as the 5-1-1 guideline) are observational stopwatches designed to help you record labor intervals. THEY DO NOT CONSTITUTE CLINICAL LABOR TRIAGE OR AN EMERGENCY EVACUATION SYSTEM. Every labor progression is biologically unique. If you experience active bleeding, unbroken or ruptured amniotic fluid (water breaking), continuous intense pain, fever, or feel unwell, do not wait for timer calculations—contact your delivery hospital or OB-GYN immediately.
2.5 IMMEDIATE MEDICAL EMERGENCIES:
IF YOU BELIEVE YOU OR YOUR BABY ARE EXPERIENCING A MEDICAL EMERGENCY, CALL YOUR LOCAL EMERGENCY SERVICES (SUCH AS 911 OR 112) OR IMMEDIATELY PROCEED TO THE NEAREST HOSPITAL EMERGENCY DEPARTMENT.
3. User Eligibility & Apple ID
By using LunaCycle, you represent that you meet the minimum age required by the Apple App Store in your jurisdiction (typically 12+ or 13+). If you are under the age of majority in your jurisdiction, you confirm that you have obtained consent from a parent or legal guardian to download the App and agree to these Terms.
LunaCycle does not require account creation, passwords, or email registration. All purchases, subscriptions, and family sharing privileges are tied directly to your authenticated Apple ID managed via iOS.
4. Premium Subscriptions (LunaCycle Pro)
LunaCycle offers optional premium capabilities ("LunaCycle Pro") providing clinical biomarker logging (Cervical Mucus classification, Basal Body Temperature curves), full pregnancy timeline utilities (Fetal Kick Counter, Hospital Bag checklist), contraction analysis with report export, and full health calibration.
Billing & Subscription Architecture:
- Apple App Store Processing: All in-app purchase transactions are handled exclusively by Apple Inc. through StoreKit and verified securely via RevenueCat. We never collect or store payment card details.
- Subscription Plans: Available as auto-renewing subscriptions (e.g., Monthly or Annual) or as a Lifetime Access purchase.
- Free Trial Periods: Certain plans may include an introductory free trial period. If a free trial is offered, you will be billed upon completion of the trial period unless you cancel at least 24 hours before the trial ends.
- Automatic Renewal: Subscriptions automatically renew at the standard listed rate unless auto-renew is disabled in your Apple ID Account Settings at least 24 hours prior to the conclusion of the active billing cycle.
- Cancellation: You can manage or cancel your active subscription at any time by opening your iOS device Settings > [Your Apple ID Name] > Subscriptions.
- Refund Policy: Because all financial transactions are executed directly by Apple, BeliveApp Tech is not authorized to process refunds directly. Any refund requests must be submitted directly to Apple at reportaproblem.apple.com.
5. Lifetime Access Pass
If you select the "Lifetime Access" tier, it is categorized under Apple StoreKit as a Non-Consumable purchase. This is a single, one-time payment that permanently unlocks LunaCycle Pro features for as long as the application is maintained and supported by BeliveApp Tech. The Lifetime Pass contains no recurring fees and can be restored at any time across iOS devices sharing the same Apple ID via the "Restore Purchases" feature.
6. Limitation of Liability & "As Is" Warranty
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE JURISDICTIONAL LAW, LUNACYCLE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PREDICTIVE ACCURACY, OR SYSTEM COMPATIBILITY.
IN NO EVENT SHALL BELIVEAPP TECH, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:
- Any decision, medical action, or inaction taken in reliance on calculations, logs, or dates generated by the App.
- Unintended pregnancy, delayed diagnosis, or missed clinical appointments.
- Data loss resulting from device loss, factory reset, operating system corruption, or failure to perform iOS iCloud device backups.
7. On-Device Storage & Backup Responsibility
As detailed in our Privacy Policy, LunaCycle prioritizes confidential health sovereignty: all cycle dates, symptoms, notes, and maternal records are stored strictly on your local physical device. BeliveApp Tech does not maintain cloud servers containing your health logs.
Consequently, you are solely responsible for managing your physical device security (such as Face ID, Passcode, and biometric gates) and for maintaining regular device-level backups via Apple iCloud or iTunes to safeguard your data against physical loss or hardware replacement.
8. Changes to Terms of Service
We reserve the right to revise or replace these Terms of Service at any time to reflect software updates, regulatory mandates, or clinical standards. When updates occur, the revised version will be published on our official website with an updated "Last Updated" date. Your continued utilization of LunaCycle after any modifications constitutes acceptance of the amended Terms.
